Succession is the legal process that allows a social housing tenancy to pass from a deceased tenant to another person. It exists to prevent immediate homelessness after bereavement, but it is not automatic and it is not unlimited. Understanding this before a crisis happens is one of the most important forms of protection a tenant can give their household.
Most social housing tenancies allow for just one lawful succession. This means that if a tenancy has already been passed down, such as from a parent to a spouse, it may not be transferred again. Many families are ignorant of this until they are informed, they are not entitled to success. At that point, choices become limited and time-sensitive.
A spouse or civil partner typically has the strongest succession rights. If they were living in the property as their primary residence at the time of the tenant's death, succession is typically simple. This includes both legally married couples and registered civil unions. In these circumstances, the tenancy typically continues on the same terms, providing stability during a period of loss.
Long term partners who are not formally married can also have succession rights, but proof becomes essential. Landlords will want evidence that the property was genuinely the person’s main home. This can include joint benefit claims, council tax records, bank statements, GP registrations or utility bills. The burden of proof often falls on the surviving partner, which can feel cruel during grief, but it is a legal requirement.
Other family members may qualify, but under stricter conditions. Adult children, siblings, parents or other relatives usually need to show that they lived in the property as their main home for a continuous period before the tenant’s death. This period is often at least twelve months, though it can vary depending on the landlord and tenancy type.
Tenancy type has a significant impact on succession rights. Secure and assured tenancies typically provide greater protection. Flexible tenancies, starting tenancies, and introduction tenancies typically have more limited succession rights. In some situations, succession may be impossible, however discretionary rehousing may be granted as an alternative.
Supported and sheltered homes introduce additional difficulties. Even if a succession right exists, the successor must often meet the eligibility requirements for that sort of accommodation. If the housing was given particularly to meet age, disability, or support needs, the landlord may claim that the house is no longer acceptable.
Even when succession is granted, it does not always mean the successor can remain in the same home indefinitely. If the property is significantly larger than the successor’s assessed need, the landlord may consider it under occupied. In these cases, alternative accommodation may be offered.
